A Delhi court has fined the police for “unnecessarily torturing” an accused in the February 2020 riots case, observing that the commissioner of police and other senior officers were repeatedly given personal interference in these cases. The instructions given have been ignored. Chief Metropolitan Magistrate Arun Kumar Garg imposed a fine of Rs 25,000 on the police for delay in filing an application for separation of complaints and further investigation in the case of all the seven accused equally.
Court was furious over negligence
The court had on October 12 directed Police Commissioner Rakesh Asthana to submit a detailed account of the steps taken for proper investigation and prompt hearing of these cases related to the North-East Delhi riots. Along with this, the court had also directed the Home Secretary of the Central Government to investigate the whole matter and impose fine on the erring officials and deduct this amount from their salary. The fine was imposed on him due to repeated requests by the police to adjourn the hearing on the ground that further investigation in the matter is on.
Instructions were given to separate the complaint
In September, the Additional Sessions Judge had questioned why five incidents of riots on different dates in three different divisions of Delhi’s Bhajanpura area have been clubbed into one FIR and directed the separation of Aqeel Ahmed’s complaint. During the trial before the magistrate’s court, the Special Public Prosecutor (SPP) said that Ahmed’s complaint was set aside but the status report filed by the Investigating Officer (IO) did not mention anything about setting aside his complaint.
“The request of the IO for setting aside the complaint and further investigation in the matter is allowed, however, the delay in this has resulted in unnecessary harassment of the accused for which a fine of Rs 25,000 is imposed on the state,” the court said. ‘
