The court was hearing Fathima’s plea seeking a direction to release her in the Unlawful Activities (Prevention) Act (UAPA) case related to the alleged larger conspiracy.
Police said the habeas corpus petition of Fatima is not maintainable and it is nothing but an abuse of the process of law. The police said that this petition deserves to be dismissed.
A vacation bench of Justice Rekha Palli and Justice Amit Bansal directed Fathima’s counsel to file a reply on the state’s response and listed the matter for June 18.
The reply filed by advocates Amit Mahajan and Rajat Nair, appearing for Delhi Police, claimed that the woman’s petition is false, baseless and futile and also an abuse of the process of law.
Significantly, violence between supporters and opponents of the Citizenship Amendment Act (CAA) was followed by communal violence on February 24, 2020, in which 53 people were killed and around 200 others were injured.
Fatima was arrested in the case on April 11 and is currently in judicial custody. Besides him, the other accused in the case are Khalid, Ishrat Jahan, Tahir Hussain, Meeran Haider, Natasha Narwal, Devangana Kalita, Asif Iqbal Tanha and Shifa Ur Rehman and they are also in judicial custody at present.
