The Delhi High Court made a poignant remark while denying bail to a 65-year-old man accused of raping a daughter-in-law. The court said that rape is not just a physical assault, but it can destroy the entire personality of the victim along with spoiling her mind. Justice Subramaniam Prasad also said that rape is a very heinous crime. The victim may have to bear the trauma of this for years.
The court, in an order passed on October 21 while rejecting the bail plea, said that the petitioner has been accused of raping the daughter-in-law. The possibility of his threatening the victim cannot be ruled out at this point of time.
The court also noted that the FIR was registered in the present case after a gap of two months. This does not mean that the daughter-in-law has filed a false case.
The judge said, “Rape is a very heinous crime. It carries a minimum sentence of 7 years. It can go up to life imprisonment. The FIR states that the victim (daughter-in-law) was scared and hesitant to tell her parents about the incident, but when she was repeatedly tortured and raped by the petitioner, she took courage. Mobilized and informed his parents about the incident.’
“Rape is not just physical assault, it is often devastating to the entire personality of the victim,” the judge said. The act of rape has the potential to frighten the mind of the victim and this trauma can last for years.’
The court, observing that the petitioner is in custody since August last year, directed the trial court to hear and examine the arguments of the daughter-in-law regarding the allegations at the earliest.
The petitioner sought bail on the ground that the matter arose out of a matrimonial dispute and the daughter-in-law was trying to implicate everyone in the family.
The court was told that the age of the petitioner is 65 years. he is ill. A charge sheet has been filed against him before the trial court. The prosecution and the daughter-in-law had opposed the grant of bail.
